
TERMS & CONDITIONS

By purchasing, accessing, or participating in any service offered by Yassy Frank Fitness ("we," "us," or "our"), including The Glow Club membership, any Online Challenges (such as The Glow Project), and any In-Person Events, you agree to the following Terms & Conditions. Please read them carefully.
1. SERVICES OVERVIEW
1.1 Online Challenges (e.g., The Glow Project)
From time to time, we may offer specific online fitness challenges (e.g., "The Glow Project") within The Glow Club. Use of any such challenge remains subject to these terms.
Access: Members may access challenges while their membership is active.
Updates: Challenge names, content, and structure may be updated or replaced by us at any time.
1.2 Online On-Demand Workout Library (e.g., The Glow Club)
In addition to the challenge, members receive access to the on-demand library, which includes Strength, Sculpt, and Express workouts. New content is added periodically, and availability of specific workouts is subject to change.
1.3 In-Person Events
From time to time, Yassy Frank Fitness may host in-person workout events, classes, or meetups ("Events"). These are separate from online memberships and may require a separate ticket purchase.
2. MEMBERSHIP, TICKETS & BILLING
2.1 Online Membership
Fees & Plans: Membership fees and billing cycles (e.g., Monthly, Annual) are displayed at checkout. The specific price you pay depends on the plan selected (e.g., Foundation, Standard, or Annual).
Billing: Fees are billed in advance according to your selected billing cycle and renew automatically unless cancelled.
Pricing Changes: We reserve the right to update membership pricing with reasonable notice. "Foundation" or legacy pricing applies only while that specific membership remains continuously active.
2.2 Event Tickets
Tickets for In-Person Events must be purchased in advance.
Prices and inclusions will be specified on the booking page for each Event.
Tickets are for personal use and may not be resold for profit.
3. CANCELLATIONS & REFUNDS
3.1 Online Subscriptions
Cancellation: You may cancel your subscription at any time via your account settings.
Effect: Cancellation prevents future charges. Access remains active until the end of the current billing cycle.
No Refunds: Due to the immediate access to digital content, all membership fees are non-refundable, including for partial months or unused time.
3.2 In-Person Events
Cancellations & Refunds: You may cancel your event ticket and receive a full refund, provided you notify us at least 24 hours prior to the scheduled start time of the Event. Cancellations made within 24 hours of the Event are non-refundable.
Transfers: If you cannot attend but miss the refund window, you may transfer your ticket to another person, provided you notify us before the Event starts.
Event Changes: We reserve the right to change the date, time, or venue of an Event. In the case of a total cancellation by us, a full refund will be offered.
4. HEALTH & MEDICAL DISCLAIMER
Applicable to ALL Online Workouts and In-Person Events.
General Info: Our content is for educational and fitness purposes only and is not medical advice.
Consult Your Doctor: You must consult a healthcare professional before starting any exercise program, especially if you are pregnant, postnatal, recovering from injury, or have a medical condition.
Your Responsibility: Participation is 100% voluntary and at your own risk. It is your responsibility to stop if you feel pain, dizziness, or discomfort.
5. ASSUMPTION OF RISK & LIABILITY WAIVER
5.1 Assumption of Risk
You acknowledge that physical exercise, whether online or in-person, carries inherent risks of injury, illness, or death. You voluntarily assume all risks associated with participation.
5.2 Release of Liability
To the fullest extent permitted by law, Yassy Frank Fitness, its owners, trainers, employees, and venues are not liable for:
Any injury, loss, or damage you sustain during a workout or Event.
Loss or theft of personal property at In-Person Events.
Technical issues preventing access to online content.
6. CODE OF CONDUCT (IN-PERSON EVENTS)
We are committed to a safe and positive environment.
Behavior: We offer a harassment-free experience. Any behavior deemed disrespectful, unsafe, or disruptive may result in immediate removal from the Event without refund.
Safety: You agree to follow all instructions given by instructors and venue staff.
7. MEDIA RELEASE (IN-PERSON EVENTS)
By attending an In-Person Event, you grant Yassy Frank Fitness permission to record your image, voice, or likeness through photography and video. You agree that these materials may be used for marketing, social media, and commercial purposes without compensation. If you do not wish to be photographed, you must inform a staff member upon arrival.
8. INTELLECTUAL PROPERTY
All content (videos, programs, branding, guides) remains the intellectual property of Yassy Frank Fitness.
Usage: Content is for your personal, non-commercial use only.
Restrictions: You may not record, reproduce, distribute, or share login details or Event content with others.
9. PRIVACY POLICY
Your privacy is important to us.
Collection: We collect personal information (name, email, payment details) to provide our services.
Usage: Your data is used to process payments, manage memberships, and communicate with you.
Sharing: We do not share your data with third parties unless required by law or for essential service delivery (e.g., payment processors).
Compliance: We handle data in accordance with Australian Privacy Principles.
10. GENERAL TERMS
Age Requirement: You must be 18 years or older to purchase a membership or attend an Event.
Changes to Terms: We may update these terms at any time. Continued use of the service constitutes acceptance.
Governing Law: These Terms are governed by the laws of Australia.
